Terms & Conditions
ONE – Introduction
Yes, now in Europe too we are all paranoid. So much so that nowadays we must waste our precious time covering our behinds for things that were totally trivial and unimaginable a few years ago. What I mean of course is the culture of suing anyone and everybody over just about everything. Well, alright, perhaps not EVERYONE…. but hey.
So here are the Terms and Conditions for EuropeRides and Silver Cloud Publishing. Oh, and if you think there is something missing, please don’t sue me……. Instead, let me know what to add (provided I still have enough disk space left on the web server).
Seriously, though………. please read this document carefully before committing to any of our tours or other services. Because we are offering very specific and customized tours, our terms and conditions are perhaps a bit different in parts compared to those of other (motorbike) touring or travel companies.
By signing and returning the final BOOKING AGREEMENT of a tour – or otherwise agreeing to one of our services – you also AGREE to these TERMS & CONDITIONS and ACCEPT them as contractually binding between you and EuropeRides.
Personally I hate these sort of statements. I get lost in them myself, let alone our customers, but it is what lawyers want us to do. I will make available some of the important (and more PRACTICAL) parts of it separately. Such as pricing, conditions, what is included and what not, and so forth. But you will also find it all in the following text as well.

An IMPORTANT CAUTION regarding INSURANCEWe must caution you….. EuropeRides is NOT an official travel agency in the sense that we are member of any specialized organization and therefore we are also NOT covered by some of the mutual insurances membership of such organizations provide. This means that YOU YOURSELF are responsible for ALL INSURANCES necessary to make a (foreign) motorcycle trip, including (this may not be complete):
Yes, it is a nasty world we are living in these days… I am an honest man, we have an honest company and we are convinced we’ll attract honest customers only. But we still have all to be careful! |
TWO – Tour Organization and Execution
EuropeRides, a subsidiary of Silver Cloud Publishing, is the tour ‘Organizer’. Its principal offices are located at:
Zuiderhout 55, 1695 AT, Blokker, The Netherlands.
The organization is owned by François A. Dumas. Silver Cloud Publishing is an ‘umbrella organization’ and as such the official entity used by me to conduct all my business under. It is also the company officially registered for VAT, at the Dutch Chamber of Commerce, and, of course, at the Dutch Internal Revenue Service.
EuropeRides also may make use of freelance tour/motor guides for its tours, and of other third party companies to offer products (including but not limited to equipment rental, training, insurance, lodging, marketing, parts and services).
THREE – Customer
The ‘customer’ is any party to whom we agree to provide our services, paid or free.
FOUR – Products
Products of Silver Cloud Publishing’s EuropeRides include ‘organized motorcycle tours’, as well as other services, such as support in finding/arranging rentals, lodging, rider’s training, (country) information, documentation and even motor equipment, t-shirts and coffee mugs!
FIVE – Motorcycle Tours
EuropeRides‘ primary goal is to make fellow riders enjoy the wonderful regions, landscapes, towns, coasts and ROADS of Europe. We do that through providing information, and more importantly, organizing motor-tours through various areas, limited to just a few people, mainly using simple but cozy places to stay.
Our motor tours are made up of our ‘specialty’, i.e. our PRIVATE GUIDE TOURS, where the maximum of participants is 4 (oh okay, if you twist my arm we can probably accommodate one or two more).
Why not MORE !!?? Because we want you to ENJOY the riding without unnecessary complications. We also want you to enjoy the various things there are to see along the route. Things are so much easier – and ultimately more enjoyable – when one does NOT have to cope with the challenges a large group may present!
|
|
VERY IMPORTANT: PRIVACY !Unless explicitly requested otherwise and agreed to by all of a scheduled Tour’s participants, everyone on the tour must KNOW each other (i.e. man and wife, friends, family members, partners). Experience has taught us the importance of this requirement, especially in the day-to-day confines of a Tour’s intimate setting. Compatibility and familiarity are real advantages.Of course the one exception is ME (and possibly Nina)…. you’ll just have to make do with that ! |
We also have DAY TOURS, and even ‘SELF CATERING’ tours, where we just make arrangements for certain places and events along the route, and send you off on your own with ample documentation and information.
NOTE: For each tour you can download a DETAILED Tour Sheet with ALL relevant information about the specific tour as soon as these become available.
EuropeRides is a SMALL company with limited resources. And although we are growing already, there is a good chance your favorite period with your favorite guide (i.e. ME) is fully booked. We do already have a few ‘guides’ on call, each of them very experienced motorcycle riders with multiple talents and skills. If we feel that one of them fits your needs, we will PROPOSE so. The final call is YOURS, however, and until a trip is AGREED and BOOKED, you can always decline any such proposal.
We use THIRD PARTY offerings for RENTAL BIKES and LODGING.
While we aim to work with people we KNOW, we can not always guarantee this is the case. Everybody has limited availability. If necessary we will find you another rental company or different lodging. We cannot, therefore, guarantee you will get the bike we agreed nor the lodging we envisaged. Your satisfaction is very important to us. You have our assurance we will work diligently to resolve any issues that arise with swiftness and fairness.
EuropeRides maintains the right to make changes as appropriate. If we are required to do so, every reasonable effort will be made to secure you equal or better replacements and/or accommodations.
Alright, here’s is some ‘marketing gobbledygook’ thrown in (you may skip it):
ADVERTISING SECTION Other products and services
We also offer some associated products and services. We are working on ‘touring guides’ (printed or downloadable), have the capabilities to source Garmin and Tripy GPS equipment and can even help you source motorcycle parts in Holland and elsewhere AND we can help you with a range of services in terms of travel advice, area information, hotel/B & B arrangements, bike rental and/or storage and other such services.
We MEDIATE in all these things, because we have our feet on the floor in Europe and have a LARGE network of contacts in many countries. We even provide free services, information for your personal use on our web sites, free advice when we feel it is appropriate (we DO like to HELP fellow riders, that is how this all started in the first place).
SIX – Your Booking(s)
Back to the ‘serious’ stuff !
NO, you will not find a ‘fill-in-the-blanks’ booking form on our web site. Heck, that ain’t fair! You want to book that dream trip NOW, don’t you !!?? "…What’s up with these guys??…", you may think.
Here’s what:
ALL OUR OFFERINGS ARE CUSTOMIZED TO YOUR INDIVIDUAL SPECIFICATIONS AND REQUIREMENTS. On the BOOK-A-TRIP PAGE you will find various ways to get in touch with ME. When you do, the WORK starts…. this is how it works:
- We need to get to know each other, and I need to understand what your ideas, whishes, preferences and plans are. If you don’t have any, we’ll help you get some, don’t worry !
- Once we have established and agreed upon your expectations I will draw up a detailed Tour Plan, we will discuss it, adjust it, and adjust it some more….. until YOU and ME are satisfied. Only THEN will we send you a Booking Agreement, formally confirming all the items we’ve discussed – the trip plan, the PRICE, the additional services….. the lot – and It, of course, will adhere to the rules and regulations stipulated here and it is the final contract between you, the Customer, and us, EuropeRides.
NOTE: Bookings are NOT automated, and tours/periods/dates mentioned on our website or on other documents provided by us are NOT binding until (1) a personal agreement has been reached and (2) a Booking Agreement has been signed and received by EuropeRides.
Unless otherwise agreed bookings need to be finalized 60 days BEFORE start of a tour !
SEVEN – What’s Included In Your Tour And What’s Not
The simple, and complex, answer is: it depends.
Inclusions:
In our Private Guided Tours the following costs are included:
- cost of the Guide (his travel cost and fee)
- traffic/rules instruction
- lodging during the tour
- breakfast every day
- museum or events entrance fees
- documentation and charting material
- the motorcycle rental – including motorcycle insurance from the rental company
- bike storage space (cases) or luggage transport
- a nice souvenir (of course).
Other things that CAN be included – but are not part of the ‘standard’ package – include the following:
- incidental expenses
- toll road charges
- baggage transport
- transfer to-from bike rental and/or lodging
- riding training
- a photo CD of the trip
- a web log during trip time
- mobile phone rental
- GPS rental
In the German Culinary Tours a wonderful buffet is included (of course!)
Exclusions:
Unless other arrangements have been discussed, agreed upon and documented in your Booking Agreement, the following items are not included in the cost of your tour:
- Insurance of any kind beyond what may be included as part of your motorcycle rental (we can mediate where that makes sense)
- Deposit for motorcycle rental (!)
- fuel cost
- additional bike rental cost when surpassing maximum rental miles
- riding gear and/or equipment (clothes, boots, gloves, helmets, rain gear)
- food and drinks (except breakfast – or when specifically offered as part of a Tour)
- the travel from your departing location to the Tour’s starting place
- subsequent stay before and after the Tour’s scheduled days
Possible Extras
Because we are a flexible and personalized-service company, we do offer certain extras, ALWAYS upon request and in mutual agreement, and provided when we are confident we may successfully source the extras. We do NOT want you to pay for something we are not 100% supporting. Extras may include things such as:
- temporary (European) mobile phone
- hotel sourcing and reservations at airports or elsewhere
- airport-to-tour and tour-to-airport transfers
- bike-to-bike communication (not sure we can still do this)
- additional travel arrangements outside the tour
- additional rental days (extension of stay)
- non-bike, guided (city) tour
- Nina
Oh, that last ‘item’? When possible (depending on her own job and spare time) my dear wife Nina may accompany us on tours I am guiding. She’s a dear, and a great organizer of things! She also keeps me out of trouble.
EIGHT – Our Rates
Because of the highly personalized nature of the motorcycle touring services we provide and the fact no two tours will be exactly alike, we do not have fixed rates – really.
Pricing for each booking will be determined, detailed and fixed using the process referenced in section Six.
NOTE: The prices printed on the Trip Headings and on the Pricing Page are representative samples , to give you a rough idea, and no rights can be claimed from them.
We will also give a (non-binding) indication of your ‘additional cost’, such as an estimate of fuel cost based on distance planned and prices known, toll-roads planned, food and beverages in the area, etc. This is just so you will be able to make an estimate of the TOTAL vacation’s price and have an idea of the additional cost to the EuropeRides invoice!
All rates quoted are in Euros, and all possible estimates in other foreign currency like US dollars will be based upon ‘current’ exchange rates at the time of calculating and no rights can be taken from such estimations.
Unfortunately both the exchange rates AND the fuel prices are VERY volatile!
In any case you will receive a guaranteed amount on your final Booking Agreement for the ‘fixed rate’ part of the offering, to be paid in advance. And what’s more, we WILL let you BENEFIT from changing situations and you will always pay a FAIR PRICE, that covers our cost and allows us a small profit after paying our many taxes !
NINE – Reservation, Payments and Deposits
Now this is the really serious part…… we actually require you to – gasp ! – pay us!
Signed Booking Agreements must be in our possession as soon as possible after agreeing to purchase a tour or event, but NO LATER THAN 60 days BEFORE IT STARTS. The SOONER the better, the larger the chance that we can indeed book the bike(s) and lodging for your preferred tour and preferred dates!
We require FULL PAYMENT IN ADVANCE for all OUR services. When initial agreement between ‘customer’ and ‘EuropeRides is reached, for tours AND for special goods delivery, a detailed Booking Agreement will be sent to you, indicating the service included and showing a detailed price list.
After CONFIRMED BOOKING of a TOUR, the full amount of invoice needs to have been transferred to our bank account in no more than two (2) two installments.
Installment 1 – 50% :
This portion of your Tour’s cost must be paid at the same time your signed Booking Agreement is returned to EuropeRides.
Installment 2 – 50% :
This portion of your Tour’s cost must be paid no later than 30 days prior to its scheduled starting date unless prior arrangements have been discussed and agreed upon formally in writing.
NOTE: Failing to do transfer funds in time may force us to cancel the service(s) agreed upon, with LIMITED OR NO REFUND (see the Cancellation and Possible Refund(s) paragraph). We incur cost and risks ourselves and REALLY need the money in time in order to guarantee you are getting what was agreed!
In case of ordering of goods, the FULL amount agreed must be in our bank account BEFORE we can order/ship any goods to you. All payments may be done using one of the following methods:
- international bank transfer
- Paypal on-line transfer (also accepts credit cards that way)
Certain cost will have to be paid LOCALLY, like bike rental will be paid upon picking up the bikes at the dealer/rental company, including INSURANCE and an ASSURANCE DEPOSIT. (The bike rental fee is included in the tour price). You will have to pay any ADDITIONAL cost the rental agency may charge yourself – for instance when riding more miles than included in the standard rental, possible damages incurred, etc.). These additional cost are of course not included in the tour price.
Exchange rates, bank commissions, petrol prices
Exchange rates are SUBJECT TO CHANGE and unfortunately totally out of our control. In fact, nobody seems to have any control over them these days. EuropeRides is NOT responsible for bank’s commissions on money transfers or otherwise and will require the Customer to pick up any tabs imposed by national or international money transfers (banks), as well as for exchange commissions.
Guess WHO’s getting rich?
ALL OUR PRICES are QUOTED IN EUROS, and all reference to other currency are based upon exchange rates as known at the time of discussing them. No rights can be taken from any quotes in other currency than Euros.
ALL PRICES are also INCLUSIVE of VAT and other local taxes in the various countries.
Fuel prices are even worse than the dollar rate, and that is especially true in Europe, where there is a huge tax imposed on fuel in many countries. Therefore FUEL COST IS NOT INCLUDED in the tour prices and every participant pays for them individually.
We do provide estimates for you to take into account, but the outcome depends on the actual distance covered and actual fuel consumption, which can vary depending on riding style and bike used. We do try and find you the cheapest petrol stations as much as possible, which has become one of the favorite pastimes in Europe over the years !
TEN – Cancellation & Refund Policy
We are all only human, and problems may occur. Problems that may prevent you or us from fulfilling our commitments. Hence, we need some rules for those occasions that we hope will never happen.
Rules for the Private Guided Tours :
- EuropeRides reserves the right to cancel a tour up to 30 days before its start date because of OTHER participants withdrawing, leaving us with less than the minimum required. In this case we will do one of the following: – offer you the choice of a supplemental charge (adding up to the tour’s total price) and continue anyway, or – we will REFUND the FULL PAYMENT made to EuropeRides
NOTE:
EuropeRides is NOT responsible, nor liable, for any OTHER cost or other loss connected to the planned tour and vacations (such as airfares, hotel cost, insurances etc.).
- When YOU cancel a tour after having signed the Booking Agreement, but more than 60 days prior to the actual start date of the tour, we will charge the CANCELLATION FEE of 500 EUROS and subtract any other dues already paid to third parties that we can not ourselves recover (possible reservation fees, etc.). The remainder will be refunded, of course.
When YOU cancel a tour BETWEEN 60 DAYS AND 30 DAYS prior to the actual start we will REFUND 50% of the total tour price.
- When you cancel a tour 30 DAYS OR LESS before the actual start date regrettably NO REFUNDS will be given for that tour. We can not make any exceptions to this rule, for any reason, and advise strongly to have a good CANCELLATION INSURANCE.
- In the unfortunate case where we may have to CANCEL A TOUR IN PROGRESS, because of our tour leader falling ill or having an accident or some other serious and unforeseen event, we will refund you the EuropeRides part of the tour PROPORTIONALLY. That is EXCLUDING cost of third parties, such as rental company, lodging and others, that have already been paid or will remain to be paid, and excluding the time/cost leading up to the event.
- If a TOUR IN PROGRESS has to be canceled or is partly canceled because of the Customer(s), then NO REFUNDS will be given.
Refunds will not be made for cancellations caused by circumstances beyond our reasonable control, including inclement weather, natural or human-made disaster, or Act of God. You may wish to consider obtaining trip insurance to cover expenses in the event you are unable to attend and/or continue your Tour. If a Tour is cancelled for a reason for which EuropeRides is solely responsible, you will receive a full refund. No claims whatsoever are valid in any other case than the ones mentioned above.
Rules for Other Tours:
- For the DAY TOURS (the German Culinary Tours for example) the same rules apply, with exception of the case where some Customers might retreat. The DAY TOURS will only be executed when the minimum number of participants is guaranteed.
- When we can NOT REACH THE MINIMUM, then a FULL REFUND will be given by the organizer (either EuropeRides or one of the PARTNERS, depending who is the organizer of such tours). All participants will be notified in time, of course.
Rules for Other Products:
For purchasing products there are different rules, which will be published separately, and with each product.
ELEVEN – Insurance
All participants are themselves responsible for taking care of their insurance needs, which may include one or more of the following:
- Health and accident cost
- Liability to others
- Cancellation fees and lost deposits
- Luggage, valuables, i.e. travel insurance
- Legal assistance
TWELVE – Motorcycle Rental
We do not own our own rental bikes or rental agency. As a result, we rely solely upon other companies for the bike rental.
We will do our utmost to get you the bike(s) of your choice, but there is always a chance that the rental company cannot supply the specific motorcycle. In that case an ‘equal’ bike is customarily provided.
Bike rental in Europe is VERY expensive, and one always needs to pay a huge safety deposit in advance as well. We will make certain that you can pay by credit card at the chosen rental agencies. When picking up your rental bike you will need to:
- have a passport with you and show it
- have your driver’s license with motorcycle license ready
- pay the safety deposit
You will have to abide to the specific rental company’s rules and regulations of course (which we will provide you up front if at all possible). EuropeRides is not responsible in case of breakdown of any motorcycle (rented or your own). Should you experience a breakdown, EuropeRides will do its best to assist in getting matters resolved for you as quickly as possible.
EuropeRides can not be held liable in case of prolonged problems and is in no way held to any reimbursement because of such technical problems.
Your own motorcycle – a viable transportation alternative?
If you have your own motorcycle in Europe – or want to bring yours over – great. It will dramatically change the price of our tour offers. But of course, you’ll have to add the cost of shipping back and forth. You must also ensure it conforms to all applicable rules and regulations of those countries in which you’ll be riding on your Tour. Naturally, any modifications required of your own motorcycle to comply with these rules and regulations will be completed at your expense.
We do know of some companies that arrange shipping and can get you in touch with them – or we can offer you our mediation services, if required/needed.
A consideration? Unless one stays for a longer period (more than 4-6 weeks, most with practical knowledge of this option say), the savings is negligible. So thorough calculation is required to determine the practicality of this option and its potential impact upon your travel budget.
One other consideration to go for renting instead of using your own motorcycle, is the opportunity to getting to ride a different brand and/or model for a change.
THIRTEEN – Weather
What with some of the freak weather of recent years, there is no telling what the weather will be at any given season anymore.
Not that this was much different 100 or 2000 years ago. We unfortunately can only advise you to bring rain gear and be prepared for anything.
2006 saw the wettest Fall in 300 years of weather history, and one of the hottest summers. Who knows what will be next?
EuropeRides tours will NOT BE CANCELED because of bad weather, and NO REFUNDS can be given when weather prevents us from riding the planned routes, or even riding at all. We are tough cookies – rain cannot go further than our skin, so we’ll ride!
Having said that, however, EuropeRides DOES reserve the right to add breaks or even cancel a (part of) day riding when (weather) circumstances dictate this.
It’s important to point out the decision to possibly NOT ride on any particular day and/or route is the sole responsibility of the Tour Guide.
Should you want to venture out on your own in spite of the Tour Guide’s decision, then that is of course entirely at your own risk and EuopeRides will not be liable.
SAFETY is our NUMBER ONE concern on all our tours !
FOURTEEN – Driving/Riding Experience & Skills
Now here’s something to which I would like to draw your attention.
Riding in Europe is QUITE different from riding in (especially) the US or other continents.
Our roads are often narrow and winding…. Remember, we want to take you out to see the special places of countries and regions…. not just endless miles of straight asphalt !
Traffic rules and driver’s behavior vary in different countries. There are different habits and varying rules. FORGET everything you heard about a ‘united Europe’ ;-)
It is, of course, all part of the charm of Europe…. !
We will, therefore ask you about your riding experience. NOT because we are curious or want to offend you in any way, but just because we want you to have a safe en enjoyable trip !
If you KNOW you do not feel comfortable in certain situations, please tell us. We may be able to help you through specific training and advice, or we may advise you to NOT make the trip or choose another one!
Remember, we’re brutally honest and PASSIONATE about making sure you have a GOOD TIME !
Some tour operators ask for a minimum number of miles ‘under your belt’. That indeed is a vague indication of experience. But if you did 5000 miles on straight highways in the Midwest United States, for instance, it will not really prepare you for the serpentines in the French Alps, or the narrow hollow roads in good old England.
We feel it is important to have at least two (2) years of riding experience, and VERY preferably be comfortable with slow-speed maneuvering! Anyone can ride fast on an ‘Autobahn’…..
You are ultimately the sole judge of your riding abilities; however, it’s a condition of joining us that all riders ensure they have sufficient skill and experience to safely handle the variety of weather and road conditions which may be encountered on a Tour.
By joining us you expressly represent and warrant you do have such skill and experience.
If all of that sounds daunting, it needn’t be that way. If we head out into the mountains and you’ve never done that, we can teach you – but the basics need to be present. Although we can even help you with that, too.
The GOOD NEWS is that we now have a partnership with a Dutch riding school and we can optionally arrange for a day of riders training – ‘Europe Style’ !
And then again, there’s a good chance you are actually a BETTER rider than I am or our guides are. Fine! That means you can enjoy the sights even better and we have less to worry about !
FIFTEEN – Riding Equipment & Safety
On all our tours SAFETY is our number ONE priority. It comes even before the actual goal of the tours; seeing wonderful things and having fun.
It is MANDATORY for all tour participants – both riders and passengers – to wear protective clothing when riding with us, at all times. Protective clothing here means:
- special protective ridding pants and jackets, either leather or reinforced other material NOTE: we do ride in blue jeans sometimes, when temperatures rise above the humanly sustainable…. but we’d really rather not.
- Special motor boots or at the very minimum boots or shoes that protect the ankles
- Gloves
- Helmet
We also urge you to carry rain gear…. most European countries have weather that can surprise wary travelers in ANY season ! Although some of the rental agencies offer clothing and other equipment for hire, we strongly recommend to bring your own. Chances that you’ll find good clothes in your size are uncertain…. and you wouldn’t want to ride 2500 miles in a flapping jacket, or in too tight pants, now would you !!??
Moreover we can never guarantee availability of these items
Traffic rules and regulations
Rules and regulations vary by country and are different in a few important areas as opposed to those in the US. One is ‘assumed’ to KNOW the rules in every country and legally responsible in any event. You are personally responsible for
- sticking to the national traffic rules and regulations of the countries we visit AND those that EuropeRides has established for participants.
- abiding by local traffic laws.
Not doing so gives EuropeRides the right to cancel (the remainder of) the tour. Any legal fees, fines or other disciplinary actions levied against you by the authorities are your sole responsibility. EuropeRides declines all and any liability in such cases.
We are pretty strict on this, for YOUR safety and well-being as well as that of other traffic participants in our often densely populated areas.
SIXTEEN – Travel Documents & Regulations
You are responsible for being in possession of the NECESSARY AND MANDATORY VALID TRAVEL DOCUMENTS, according to the laws of your own country and the countries you are visiting. Most European countries have similar laws on what is needed. But it may be wise to check with the authorities in one’s own country to make sure all is clear.
These include but are not limited to:
- valid and accepted ID (passport)
- visa’s if needed
- valid and accepted motorcycle driving license (preferably International License)
- proof of insurance where needed
- proof of ownership (of motorbike and expensive equipment)
- customs documents (in case of bringing bike)
SEVENTEEN – Third Party Services
Being a small company means relying heavily on third party services.
Lodging, motorbike rental, riders training, insurance, events and venues….. are not in our hands directly. Instead, our CORE BUSINESS is using our PASSION, experience and knowledge to help you get around in Europe in the most pleasant way on your/a motorcycle, see as much as possible and learn along the way.
We DO make it our issue to find reliable partners and use these exclusively as much as we can for all our offerings. We are also not selfish, so we have listed our partners on the website separately. If you, for whatever reason, wish to organize it all yourself, then PLEASE have a look at those partners first. We chose them because we feel they are good and honest people ! And you will find an interesting and constantly growing list of Internet links with interesting information for riders and travelers on our website.
EIGHTEEN – Tour Guides
What started out as a one-man company and private idea readily attracted other enthusiastic riders! So now we have three (3) additional Tour Guides on standby, enhancing our capability to ride in other areas than initially planned and to accommodate more customers during the season.
All of these Guides are freelance and in essence ‘one man companies’ that EuropeRides hires for the duration of a tour or trip. We will of course confer with you first, before assigning any of the Guides to your tour.
EuropeRides will take care of the fee and operating cost for the Tour Guides, and will include this in the price of a tour. EuropeRides will of course also take care of the selection process and ensure the quality of the individuals working with us in terms of geographical knowledge, riding skills, travel experience, customer relationship skills and last but not least safety mindedness.
In other words, we will pick the Guides that we ourselves would want to accompany us!
NINETEEN – Promotional Materials
Any photo, film or other material made and collected by EuropeRides, its affiliates, partners or tour guides remains the property of the creators and may be used for promotional purposes in marketing and advertising without needing the consent of the Customer(s) and without any charges from EuropeRides customers.Good and relevant photos made during (selected) tours will be made available to tour participants afterwards on CD, or, as an extra service, on a dedicated website or other internet space.
TWENTY – Waiver of Liability
Now for the unpleasant bit……
Customers taking part in our tours do so AT THEIR OWN RISK.
Every rider/passenger is wholly and personally responsible for any damage and/or injuries caused to themselves or to third parties, including but not limited to, rented motorcycles. By signing the Booking Agreement all those taking part agree to forgo all claims against EuropeRides, its partners and its guides for any damage or injury of any kind.
Furthermore, it is agreed by signing the Booking Agreement and Liability Waiver that EuropeRides, its owner, its partners and its Guides are not responsible for the safety of any customer and they, individually or collectively, cannot be held liable in any way for anything that may happen to a customer participating in a EuropeRides tour or event and the Customer waives any claims by Customer self, his/her family, heirs, or assigns.
All terms & conditions as laid out in this document apply to the Guides too, and moreover EuropeRides can not and will not take any responsibility or liability as to the actions of these individuals in the course of a tour, or outside of it, nor will EuropeRides be liable for any damage, injury or death inflicted upon a Tour Guide or his belongings during his work for EuropeRides.
Possible printing or other errors
We are only human and errors CAN occur. I have an old keyboard and thick fingers (no, I am not wearing my riding gloves). We reserve the right to correct possible errors at any time and can not be held responsible for any obvious errors.
Headache
I am certain that you can imagine my enormous headache after having written up all of the above ! (and I even had much appreciated help in doing so !). It really is unfortunate that one has to be so severe nowadays and I apologize for all the harsh language…. Honestly, our lawyer made me do this ! If you have a headache too, after reading all this, then be advised that we accept no liability for that… go talk to our lawyer ! ;-)
With all the legalese behind us, we can now look forward planning a tour together and welcome you on our wonderful roads around Europe and hoping, no, being CERTAIN that we’ll have a wonderful time together, soon forgetting about all the regulations above and not needing any of nasty bits of it.
We just want your tour to be an experience you’ll never forget
François and Nina Dumas EuropeRides
